Official Rules

No purchase necessary. Void where prohibited.

Please read these Official Rules carefully. They contain important information about your rights and obligations, as well as limitations and exclusions that may apply to you if you enter Norwegian’s Giving Joy® 2023 Contest, hosted by Norwegian Cruise Line. By entering the contest, you signify your agreement to these Official Rules and the decisions of the Sponsor and Administrator. If you do not agree to the Official Rules, you may not enter in the contest.

1. Overview

Norwegian’s Giving Joy® 2023 Contest (the “Contest”) is a nomination-based program established by Norwegian Cruise Line (the “Sponsor”) to recognize deserving teachers who go above and beyond for their students.

2. Entry Period

The Contest begins at 12:00:01 AM Eastern Time (“ET”) on Monday, May 8, 2023 and ends at 11:59:59 PM ET on Friday, June 9, 2023 (the “Contest Period”).

3. Eligibility

In order to nominate a teacher or yourself (a “Nominator”) you must be a current legal resident of Canada (excluding Quebec) or the 50 United States (including the District of Columbia and Puerto Rico), who is at least thirteen (13) years of age or older at the time of submitting your nomination, unless you are nominating yourself as a Nominee, in which case you must be twenty-one (21) years of age or older to be a Nominee.

In order to vote (a “Voter”) you must be a current legal resident of Canada (excluding Quebec) or the 50 United States (including the District of Columbia and Puerto Rico), who is at least thirteen (13) years of age or older at the time of voting.

If you are a minor in your province or state of residence, you must have the permission of your parent or legal guardian to participate in the Contest. Sponsor reserves the right to request proof of such permission at any period during the Contest.

A Nominator may nominate any individual that is:

  1. a legal resident of Canada (excluding Quebec) or the 50 United States (including the District of Columbia and Puerto Rico);
  2. 21 years of age or older; and
  3. an accredited teacher currently employed at a Public or Private elementary school, middle school, high school, or an accredited university or college in Canada (excluding Quebec) or the 50 United States (including the District of Columbia and Puerto Rico) (a “Nominee”).

A Nominator may nominate themselves as a Nominee. Prizes will only be awarded to the Nominees that are subjects of the winning Submissions (as defined below); Nominators will not receive a prize (unless Nominator nominated himself or herself).

Employees of Sponsor, RAVEN5 Ltd. (the “Administrator”), and their respective parents, affiliates, subsidiaries and advertising and promotion agencies (collectively the “Contest Parties”), and all respective employees, shareholders, officers, directors, agents, members, licensees, successors and assigns of the foregoing (collectively, the “Released Parties”) and members of their immediate family (spouses, parents, children and siblings) or persons living in the same household are not eligible to participate in this Contest as a Nominee, but may participate as a Nominator and/or Voter.

Please note that Finalists and/or Grand Prize Winners from the previous Norwegian’s Giving Joy® Contests in 2019, 2021 and 2022 are not eligible to be nominated as a Nominee in this Contest. However, Finalists and/or Grand Prize Winners from previous Norwegian’s Giving Joy® Contests are eligible and encouraged to nominate a Nominee (excluding themselves). Sponsor reserves the right to remove any Submission nominating a Finalist and/or Grand Prize Winner from a previous Norwegian’s Giving Joy® Contest or any other ineligible Submission from the Contest Website.

Contest is subject to all applicable federal, state, provincial, municipal, territorial, and local laws and regulations. Sponsor reserves the right to verify eligibility requirements. Void where prohibited. Participation in the Contest constitutes Nominator’s, Nominee’s or Voter’s (or if a minor, Nominator’s or Voter’s parent’s/legal guardian’s) full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Contest. Winning a prize is contingent upon fulfilling all requirements set forth herein.

4. How to Enter

To nominate a Nominee, go to contest.nclgivingjoy.com (the “Contest Website”) during the Contest Period and:

  1. Follow the online instructions to complete the nomination form including providing your Nominee’s First and Last Name, Email Address, Phone Number, Zip/Postal Code, Country, Instagram handle (optional), Twitter handle (optional), Nominator’s First and Last Name, Email Address, and Phone Number;
  2. Provide your essay nomination (up to 1,250 characters) describing why the Nominee deserves to win one of the Grand Prize Awards (as defined below). The essay should include answers to one or more of the following questions:
    1. How has the Nominee gone above and beyond to make a lasting impact on his or her students’ lives?
    2. How does the Nominee inspire his or her students to be the best they can be?
    3. What else can you share about the Nominee that makes him or her an exceptional teacher?
  3. Upload a photograph of the Nominee (your essay nomination, together with a photograph, herein, a “Submission”); and
  4. Check the box confirming that you have read and agree to abide by the Official Rules and that you have permission of the Nominee to be included in your Submission.

Submission Guidelines: Each Submission must:

  1. Include the required essay:
    1. The essay must be the Nominator’s original work;
    2. The essay must be no longer than 1,250 characters; and
  2. Include the required photograph of the Nominee you are nominating; and
  3. Have the permission of the Nominee to have the Nominee’s name and photograph/likeness entered into the Contest.

Non-compliant Submissions will not be considered. Eligible Submissions must be consistent with the Contest theme. Submissions may not:

  1. contain materials embodying the first or last names or likeness identifying any person without permission;
  2. be indecent, obscene, hateful, offensive, tortious, defamatory, or libelous;
  3. contain material that violates, infringes or otherwise misappropriates the rights of any third party (including trademark rights, copyrights, and rights of publicity);
  4. improperly or incorrectly suggest that Sponsor endorses, or is affiliated with any Nominee, Nominator, Voter or any third party;
  5. disparage or demean Sponsor or Released Parties;
  6. promote alcohol, drugs, tobacco, violence, or firearms/weapons (or the use of any of the foregoing);
  7. contain material that is unlawful in any way.

Any Submission that violates any of the foregoing restrictions, in the Sponsor’s sole discretion, shall be void and will not be considered in the Contest. By submitting a Submission, Nominator represents that he/she has obtained all necessary permissions to feature any identifiable third parties including, for clarity, the Nominee that appears in the Submission. If requested, Nominator must be able to provide such permissions in a form acceptable to Sponsor. Sponsor reserves the right to remove and/or disqualify any Submissions that it finds unlawful, or in violation of these Official Rules, all in its sole discretion. Released Parties are not responsible for lost, late, stolen, incomplete, inaccurate, invalid, un-intelligible, garbled, delayed or misdirected Submissions, all of which will be void. Sponsor reserves the right to post (or to not post) any Submission onto any Contest-related gallery. Sponsor reserves the right to remove any Submission from the Contest Website at any time, for whatever reason, including subsequent determination that a Submission does not comply with these Official Rules.

Limit: There is no limit to the number of individuals that a Nominator can nominate, but any Nominator may only nominate the same individual once. Any attempt by any Nominator to submit more than one nomination for the same individual by using multiple email addresses, identities, registrations and logins, or any other methods may void all of that Nominator’s Submissions. Use of any automated system to participate is prohibited and will result in disqualification. Only eligible Submissions uploaded through the Contest Website will be accepted. All Submissions become property of Sponsor and will not be acknowledged or returned.

5. Public Voting

During the Contest Period, Voters can vote for the Submission that they feel best embodies the spirit of the Contest by visiting the Contest Website and following the instructions to vote.

The forty (40) eligible Submissions that receive the highest number of votes at the end of the Contest Period will be deemed the Semi-Finalist Submissions (each a “Semi-Finalist Submission”) and the Nominees associated with those Submissions will each be deemed a Semi-Finalist (“Semi-Finalist”), subject to compliance with these Official Rules and final determination of Sponsor.

In the event of a tie in voting results for the final Semi-Finalist Submission, the Judging Panel (as defined below), in its sole discretion, will determine which Submission will be deemed the final Semi-Finalist Submission(s). The decisions of Sponsor and the Judging Panel are final and binding in all matters relating to this Contest.

There is a limit of one vote per Voter per Nominee and votes are subject to verification at any time. All votes must be received by 11:59:59 PM ET on Friday, June 9, 2023. Only votes submitted through the Contest Website are valid. Any attempt by any individual to vote by using multiple/different email addresses, identities, registrations and logins, or any other methods will void any associated votes and that individual may be banned from voting. No person may vote by proxy for any other person. Use of any automated system to vote or subvert the voting process is prohibited and will result in disqualification and all associated votes will be void. Votes generated by script, macro or other automated means or any other means intended to impact the integrity of the voting process, as determined by Sponsor in its sole discretion, may be void. Votes obtained by any fraudulent or inappropriate means, including, without limitation, offering prizes or other inducements to members of the public, payment for votes or offering to trade votes, as determined by Sponsor, in its sole discretion, may result in those votes being void and the respective Finalist Submission being disqualified.

6. Semi-Finalist Verification

On or about June 15, 2023, Administrator will notify the forty (40) Semi-Finalists via email and/or phone using the information provided on the Contest Website. Semi-Finalists will be required to verify their teaching accreditations by providing proof of employment. Each Semi-Finalist will be required to respond and provide verification by 11:59:59 PM ET on June 18, 2023.

If any Semi-Finalist cannot: (a) be contacted after two attempts, (b) fails to respond and/or to provide any of the requested verification within the required time period, (c) is otherwise in non-compliance with these Official Rules, (d) declines to be considered as a Finalist (as defined below), or (e) fails to satisfactorily meet the Finalist requirements as determined in Sponsor’s sole discretion, the Semi-Finalist will be disqualified and will no longer be eligible for a chance to win a prize. There will be no alternate Semi-Finalists selected in the event that a Semi-Finalist is disqualified for any reason. Sponsor reserves the right, at its discretion, to disqualify any Semi-Finalist based on the results of any verification conducted at any time during the Contest, including after the Finalist Judging has ended.

7. Judging to Select Finalists and Grand Prize Winners

Administrator, in consultation with Sponsor representatives (together, the “Judging Panel”), will judge and score each verified Semi-Finalist Submission based on the following judging criteria (the “Judging Criteria”):

  1. Relevance to the Contest theme (50%);
  2. The Nominee’s lasting impact on his/her students (30%); and
  3. Content and Originality (20%).

The Nominees associated with the Submissions that receive the top three (3) highest scores (subject to verification of eligibility, compliance with the terms of these Official Rules, and completion of the required documents as further described below) will be deemed the three (3) Grand Prize Winners in order of scores received (“Grand Prize Winners”).

The Nominees associated with each of the seventeen (17) Submissions with the next seventeen (17) highest scores (after the Grand Prize Winner Submissions’ scores) (subject to verification of eligibility, compliance with the terms of these Official Rules, and completion of the required documents as further described below) will be deemed the Finalists (each, a “Finalist”).

In the event of a tie, an additional “tie-breaking” judge will determine the Finalists or Grand Prize Winners based on the criteria listed herein. Decisions of Sponsor and Judging Panel are final and binding on all matters relating to this Contest.

8. Odds

The odds of winning depend upon the number of eligible Submissions received during the Contest Period, the judging criteria and the number of votes received.

9. Winner Notification

On or about June 27, 2023, Administrator will notify the three (3) Grand Prize Winners and the seventeen (17) Finalists by email and/or phone using the information provided on the Contest Website. The Grand Prize Winners and each Finalist will be required to respond to Administrator by 11:59:59 PM ET on June 30, 2023, and will be required to sign and return, by 11:59:59 PM ET on June 30, 2023, an Affidavit of Eligibility, a Liability Release, a Publicity Release (except where prohibited by law), and a W9 or W8 tax form (as applicable) (together, the “Release Forms”). If applicable, the Release Forms will require eligible winners to furnish his/her TIN for the sole purpose of tax reporting, as required by law.

All Release Forms must be received by Administrator by the date provided in the respective notifications. If any Grand Prize Winner or Finalist cannot: (a) be contacted after two attempts, (b) fails to respond and/or to provide any of the requested Release Forms within the required time period, (c) is otherwise in non-compliance with these Official Rules, (d) declines to or cannot accept the prize to be awarded, or (e) fails to satisfactorily meet the requirements as determined in Sponsor’s sole discretion, he/she will be disqualified and will no longer be eligible for a chance to win a prize.

In the event that a Grand Prize Winner is disqualified for any reason, Sponsor, in its sole discretion, may select an alternate Grand Prize Winner whose Submission has the next highest score based on the judging criteria, time permitting.

In the event that a Finalist is disqualified for any reason, Sponsor, in its sole discretion, may select an alternate Finalist whose Submission has the next highest score based on the judging criteria, time permitting.

Sponsor reserves the right, in its sole discretion, to disqualify any Grand Prize Winner or any Finalist based on the results of any verification conducted at any time during the Contest.

10. Prizing and Approximate Retail Value

Finalist Prizes

Seventeen (17) Finalist prizes (each, a “Finalist Prize”) are available to be won, each consisting of a 7-day cruise certificate for Finalist and one (1) guest (each, a “Guest”) valid for sailings originating from the U.S. and Canada, including voyage fare plus NCL’s Free At Sea offer (additional details available at www.ncl.com/cruise-deals/free-at-sea) gratuities, taxes, fees, and service charges.

The Approximate Retail Value (“ARV”) of each Finalist Prize is $7,500.00 USD. Total ARV of all Finalist Prizes is $127,500.00 USD.

Grand Prizes

Three (3) Grand Prizes (each, a “Grand Prize”) are available to be won, each consisting of:

  1. a 7-day cruise certificate for Grand Prize Winner and one (1) Guest valid for sailings originating from the U.S. and Canada, including voyage fare plus NCL’s Free At Sea offer (additional details available at www.ncl.com/cruise-deals/free-at-sea), gratuities, taxes, fees, and service charges; and
  2. an invitation for Grand Prize Winner and one (1) Guest who is 21 years of age or older to Norwegian Viva’s Christening Voyage, sailing from Miami, Florida from November 28, 2023 to December 1, 2023. This portion of the Grand Prize includes:
    1. roundtrip coach-class airfare for Grand Prize Winner and his/her Guest departing from a major airport located near the Grand Prize Winner’s home (as determined by Sponsor in its sole discretion) to Miami, Florida;
    2. one (1) night hotel accommodation on November 27, 2023 (as determined by the Sponsor in its sole discretion) in a standard room based on double occupancy, including breakfast, taxes and fees;
    3. roundtrip ground transfers from the airport to the hotel to the cruise port; and
    4. a 4-day cruise for Grand Prize Winner and one (1) Guest on Norwegian Viva’s Christening Voyage, sailing from Miami, Florida from November 28, 2023 to December 1, 2023, inclusive of F&B, WiFi, and other amenities provided to inaugural guests.

The ARV of each Grand Prize is $8,850.00 USD. Total ARV of all Grand Prizes is $26,550.00 USD.

Total ARV of all prizes is $154,050.00 USD.

Conditions for the Cruise Certificate Portion of each prize:

Cruise certificate portion of each prize must be booked by December 31, 2023 and sailing must be completed by no later than December 31, 2024. Reservations and sailing are subject to cruise certificate terms and conditions, availability and blackout dates are the decisions of Sponsor. Prize excludes air transportation, ground transportation, shore excursions and other personal expenditures. Cruise certificate includes Free At Sea offer (additional details available at www.ncl.com/cruise-deals/free-at-sea). Please note that the Free At Sea: FREE Unlimited Open Bar offer is only available to Guests that are twenty-one (21) years of age of older at the time of booking the cruise.

No promotions are combinable under this program. All other expenses not specified herein with respect to prizes are the sole responsibility of the winners. No holiday sailings will be permitted (Thanksgiving, Christmas Eve/Day, and New Year’s Eve/Day). Not valid for voyages on Pride of America or any ship added to the Sponsor’s fleet as of May 9, 2023. Changes or cancellations made less than one-hundred-twenty (120) days from original sailing date will result in a forfeiture of the cruise certificate.

Due to the nature of the prizes, each Winner and their Guest must be available to travel travel on the same itinerary on dates specified by Sponsor, or the 7-day cruise certificate prize may be forfeited. Sponsor, in its sole discretion, reserves the right to substitute prizes of equal or greater value if advertised prizes become unavailable. Sponsor’s determinations regarding the awarding of prizes are final. No prize substitutions except as provided herein. Ships’ Registry: Bahamas and United States of America. No individual (including any Guest) under twenty-one (21) years of age will be booked unless accompanied by an adult twenty-one (21) years or older. Prizes are not transferable and may not be given, bartered, sold, or exchanged for cash or another prize, except at Sponsor’s sole discretion due to prize unavailability for any reason and then only for a prize of equal or greater value.

Conditions for Norwegian Viva’s Christening Voyage Portion of each Grand Prize:

Travel, along with hotel accommodations for Grand Prize Winners and their Guests, for the Norwegian Viva Christening Voyage portion of the Grand Prize, shall be booked by Sponsor following verification of Grand Prize Winners. Actual value may vary based on airfare fluctuations and distance between departure airport within Canada or the 50 United States (including the District of Columbia and Puerto Rico) and Miami, Florida destination.

Due to the nature of the prizes, Grand Prize Winners must be available to attend Norwegian Viva’s Christening Voyage, sailing from Miami, Florida from November 28, 2023 to December 1, 2023. If any Grand Prize Winner is unable to attend, the Norwegian Viva’s Christening Voyage portion of the prize will be forfeited in its entirety, without replacement, provided however that the 7-day cruise certificate portion of the prize remains eligible for redemption in line with these Official Rules. All Guests must have reached twenty-one (21) years of age or older prior to signing the requisite Liability and Publicity Releases in order to accompany Grand Prize Winners on Norwegian Viva’s Christening Voyage. Travel arrangements are subject to availability and other restrictions.

Each Grand Prize Winner and their Guest must travel on the same itinerary and, if departing from outside the United States, have all required valid passports and visas (with the term “valid” being defined as what is valid under United States and foreign laws) at the time of departure from the respective country including up to and including the time of return to the respective country. In the event for any reason a Grand Prize Winner does not have any required valid passport/visa at the time of departure neither such Grand Prize Winner nor their Guest may travel and the Norwegian Viva’s Christening Voyage portion of the prize will be forfeited in its entirety and nothing will be substituted in its place, but if at the time of departure such Grand Prize Winner does have any required valid passport/visa and his/her Guest does not have required valid passport/visa, such Grand Prize Winner may travel unaccompanied by Guest and such Grand Prize Winner may not choose a new Guest. There are no deviations to travel allowed except as approved by Sponsor in its sole discretion. If any winner’s residence is in close enough proximity to the destination city, as the Sponsor determines in its sole discretion, the Sponsor may provide ground travel in lieu of air travel.

General Prize Conditions

In accepting a prize, Finalists and Grand Prize Winners are responsible for all federal, state, county, provincial, local and all other taxes (including income and withholding) on the prize and costs and expenses not specifically listed above as part of the prize, including, without limitation, surcharges, service charges, meals, food, beverages, insurance, valid travel documentation, passports, medical/health expenses, gratuities, excess baggage fees, communication charges, and all other personal expenses and incidentals.

All Grand Prize Winners, Finalists and Guests must abide by all Sponsor’s policies and terms and conditions, including the requirements outlined at www.ncl.com/sail-safe. Sponsor reserves the right to revoke full or partial prizes from Grand Prize Winners, Finalists or Guests who it deems, in its sole discretion, may be intoxicated, be a safety risk, have violated any policy or law, or may bring the Sponsor into disrepute.

All details and other restrictions of prizes not specified in these Official Rules will be determined by Sponsor in its sole discretion. Actual value of prizes under this Contest may be lower or higher at the time of its fulfillment, and any difference between actual value and the stated ARV (if actual value is lower than stated ARV) will not be awarded. Each prize ARV represents Sponsor’s good faith determination, is final and binding and cannot be challenged or appealed. Sponsor is not responsible if any element of the prize is delayed, postponed or cancelled for any reason. Prizes are non-transferable, non-refundable, and no substitution or cash redemption will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right, for whatever reason, to substitute a prize (or any component thereof) for one of equal or greater value.

Winners must be able to accept the prizes as presented or the respective prize may be forfeited in its entirety and an alternate potential winner may be selected in Sponsor’s sole discretion.

11. Release; Indemnification; Disclaimer of Warranty

By participating in the Contest, all Nominators, Nominees and Voters (or if minors, their parent/legal guardians) agree to forever and irrevocably release and hold harmless the Released Parties from any and all liability for any loss, harm, damage, injury, cost or expense of any nature whatsoever (including attorneys’ fees) (collectively, “Losses”) which may occur in connection with (a) the Contest or any element thereof, including entry or participation therein, (b) delivery, possession, acceptance and/or use or misuse of any prize or component thereof, or (c) participation in any Contest-related activity or prize-related activity including without limitation in each case any Losses that may be caused or contributed to by (1) any wrongful, negligent or unauthorized act or omission on the part of any of the Released Parties, or any of their independent contractors or any other person or entity not an employee of any of the Released Parties, or (2) any other cause, condition or event whatsoever beyond the control of any of the Released Parties. In addition, by participating in this Contest, each Nominator, Nominee, and Voter (or if a minor, their parent/legal guardian) agrees to indemnify and hold harmless the Released Parties from and against any and all damages, losses, costs and expenses (including amounts paid in settlement and reasonable attorneys’ fees) incurred by any of the Released Parties in connection with any third-party claim, demand, liability, suit, proceeding or action arising out of or resulting from (i) breach or alleged breach of any representations, warranties or agreements of Nominator, Nominee, or Voter (as applicable) hereunder, or (ii) Nominee’s possession, use or misuse of any prize or component thereof. Each Nominator, Nominee, or Voter (as applicable) hereby acknowledges that the Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to any prize (or any components thereof) and that, except as prohibited by applicable law, prizes are provided “as is” without warranty of any kind, either express or implied. Released Parties hereby disclaim all such warranties, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose and/or non-infringement.

12. Publicity

Except where legally prohibited, participation in the Contest constitutes Nominators’ (or if minors, Nominators’ parent/legal guardian’s) and, pursuant to signed releases, respective Nominees’ agreement and consent to the Contest Parties’, use of Nominee’s names, likenesses, photographs, videos, voices, opinions and/or hometowns & states/provinces/territories, and/or Submissions for promotional purposes in any media now known or hereafter devised, worldwide, without further payment or consideration, notice, review or approval.

Providing a Submission constitutes Nominator’s and Nominee’s consent to give Sponsor, its successors, assigns and licensees, a royalty-free, irrevocable, perpetual non-exclusive license to use, reproduce, modify, publish, create derivative works from, and display in whole or in part, the Submission, on a worldwide basis, and to incorporate it into other works, in any form, media or technology now known or later developed, including for promotional or marketing purposes without further compensation or approval. Such consent includes, among other things, consent for the Sponsor to display Nominator’s Submission in a public gallery to promote the Contest and Sponsor and consent for the Sponsor to incorporate Nominator’s Submissions in other content (including videos and other media) to support, advertise, and/or promote Sponsor and current and future iterations of the Contest.

If requested, Nominator (or if a minor, Nominator’s parent/legal guardian) will sign, and will cause his/her respective Nominee to sign, any documentation required for Sponsor or its successors, assigns and licensees to make use of the non-exclusive rights Nominator is granting to use the Submission.

13. General

All decisions of Sponsor in connection with this Contest shall be binding and final in all respects. Sponsor reserves the right to terminate, cancel, suspend and/or modify the Contest, if intervening circumstances warrant, within Sponsor’s sole discretion, due to any fraud, virus or other technical problem which corrupts the administration, security, or proper entry or voting into the Contest, or for any other reason. In such event, Sponsor reserves the right to award the prizes from among the eligible Submissions received up to the time of the termination, cancellation, suspension and/or modification. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry or voting process or the operation of the Contest or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term or provision of these Official Rules shall not constitute a waiver of that term or provision.

14. Limitation of Liability

Without limiting anything set forth above in these Official Rules, Released Parties shall not have any obligation, responsibility or liability, including any obligation or responsibility to provide a prize to any Prize Winner, with regard to: (a) Submissions entered through the use of any robotic or automated device/computer program or any other non-human mechanism, entity, or device; (b) Submissions or votes in excess of the stated Submission/vote limit; (c) Submissions that are illegible, late, forged, destroyed, lost, misplaced, stolen, misdirected, tampered with, incomplete, deleted, damaged, garbled, altered or otherwise not in compliance with or in violation of these Official Rules, whether caused by any equipment or programming associated with or utilized in the Contest or any other reason beyond Released Parties’ control; (d) any technical or human error which may occur in the creation, submission, assignment or processing of Submissions or votes in the Contest, including any technical or human error in connection with any social media platforms, Contest Website and/or the hosting thereof; (e) Submissions, votes, prize claims or notifications that are not received by the intended recipient due to transmission, technical, computer or human failures or error of any kind, including any Submissions, votes, prize claims or notifications that are delayed, misdirected, or undelivered as a result of any failure or problem with the availability, functionality, operability or use of any network, server, ISP, website (including the Contest Website), computer, internet connection, hand-held mobile device, social media platform, or any other equipment or connection used in connection with the Contest; (f) changes in a Nominator’s (or if a minor, his/her parent/legal guardian’s) or Nominee’s information which affects the ability to contact such Nominator (or, where applicable, his/her parent/legal guardian) or Nominee; (g) typographical errors in Contest promotional material; (h) cancellations and/or delays or any change by any company or any other persons providing any of components of the prizes due to reasons beyond the control of any of the Released Parties; (i) any interruptions/postponement/cancellation of Contest; (j) human error; incorrect or inaccurate transcription of Submission information; (k) any technical malfunctions of the computer on-line system, computer dating mechanism, computer equipment, software, any social media platform, or internet service provider utilized by any of the Released Parties or by Nominator; (l) interruption or inability to access the Contest, any Contest-related Web pages (including the Contest Website), any social media platform, or any on-line service via the Internet due to hardware or software compatibility problems; (m) any damage to Nominator’s, Nominee’s, or Voter’s (or any third person’s) computer and/or its contents related to or resulting from any part of the Contest; (n) any lost/delayed data transmissions, omissions, interruptions, defects; and/or (o) any other errors or malfunctions, even if caused by the negligence of any one or more of the Released Parties.

15. Disputes

Any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved exclusively by the appropriate federal or state court located in Miami-Dade County, Florida, U.S.A., and all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Nominators, Nominees, Voters (or if minors, their parents/legal guardians) and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Florida, U.S.A. without giving effect to any choice of law or conflict of law rules (whether of the State of Florida, U.S.A. or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Florida, U.S.A.. Except where prohibited by law, all Nominators, Nominees and Voters (or if minors, their parents/legal guardians) agree that (i) any and all such disputes, claims, and causes of action shall be resolved individually, without resort to any form of class action; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys’ fees; (iii) under no circumstances will Nominators, Nominees or Voters (or if minors, their parents/legal guardians) be permitted to obtain awards for, and Nominators, Nominees and Voters (or if minors, their parents/legal guardians) hereby waive all rights to claim, indirect, punitive, incidental, consequential and/or any other damages, other than actual out-of-pocket expenses; (iv) they waive any and all rights to have damages multiplied or otherwise increased; (v) they irrevocably consent to the personal jurisdiction of the aforesaid courts, as applicable to each such Nominator, Nominee or Voter (or if minors, their parents/legal guardians), and waive any claim of forum non conveniens or lack of personal jurisdiction that they may have; and (vi) if any provision of these Official Rules is declared invalid or unenforceable, such provision will be deemed modified to the extent necessary and possible to render it valid and enforceable, and that in any event, the unenforceability or invalidity of any provision will not affect any other provision of these Official Rules, and these Official Rules will continue in full force and effect, and be construed and enforced, as if such provision had not been included, or had been modified as described above, as the case may be.

16. Privacy

Information collected through the administration of the Contest is subject to and may be used and shared by Sponsor, including in connection with Sponsor’s administration of this Contest to notify Nominees, verify and confirm Finalists and Grand Prize Winners, and to fulfill prizes, in accordance with Sponsor’s Privacy Policy at https://www.ncl.com/about-us/privacy-policy and applicable law. Personal information collected will be stored on servers located in the United States and may be accessible to U.S. law enforcement, courts and other governmental institutions pursuant to the laws of the United States.

The winners list will be posted online at https://nclgivingjoy.com/ once available.

Official Rules and Winners List requests must be received no later than August 31, 2023.
